TERMS + CONDITIONS

This is your agreement with Lulu Jackson Bridal. When placing an order with Lulu Jackson Bridal you agree to all terms contained within.

1. Custom made garments.

A custom made garment is designed and made for you based on the imagery, ideas, requirements and/or sample fittings discussed during the consultation process, and the measurements Lulu Jackson Bridal receives from you at this time. A garment(s) is designed and made to fit your body. The design, fit and construction are ultimately at the discretion of Lulu Jackson Bridal.

2. Intellectual property.

All intellectual property including discussions with the designer, the garments design, drawings, pattern and samples remains the sole property of Lulu Jackson Bridal.

3. Pricing.

3.1   Quotes for custom made garments are estimated based on the ideas discussed in the consultation process. They are priced as a service and influenced by a combination of materials, labour cost, intellectual property and expertise.

3.2   The quote is an estimate only and the final price is subject to change. The client will be notified and consulted before Lulu Jackson Bridal carries out any work which may increase the final price to an amount higher than the quoted amount.

3.3 All prices are quoted in New Zealand Dollars and include GST, packaging and shipping charges.

4. Payment terms.

4.1 50% Deposit on quoted amount:

A. To confirm your order Lulu Jackson Bridal requires a 50% deposit on the amount quoted during consultation. Upon payment of the deposit, you are confirmed as a customer of Lulu Jackson Bridal and agree to these terms and conditions. Design and production of your garment(s) may then commence.

B. A refund of your deposit may be issued at the discretion of Lulu Jackson Bridal, and only before confirming a design concept. However, there may be a $300 cancellation fee to cover the cost of administration, labour and materials associated with your order. All items pertaining to your order would remain the property of Lulu Jackson Bridal.

4.2   Full payment of outstanding amount:

A. Once the final garment is ready the outstanding payment amount is required. This is the outstanding amount of the final cost. The final cost may be the same, more or less than the quoted amount (see clauses 3.1 & 3.2).

B. Once full payment has been made the garment(s) is accepted as final and ready for collection/delivery. Lulu Jackson Bridal is not liable for any damages or changes from this point.

C. All items pertaining to your order remain the property of Lulu Jackson Bridal until full payment is made.

4.3   General payment terms:

A. All payments are due 7 days after the invoice date unless discussed otherwise. Lulu Jackson Bridal will not be liable for late delivery of garments from late payments made. It is the customers responsibility to ensure that the wedding or event date is stated correctly on the first invoice.

4.4   Refunds, Returns and Exchanges:

A. All garments are custom made, to order, and based on the customers personal measurements and requirements therefore refunds, returns or exchanges are not provided.

B. All items are quality controlled before the final invoice is issued. In the unlikely event a fault is missed customers will be entitled to a repair or replacement. Only in the event of a major fault, which cannot be amended, at the discretion of Lulu Jackson Bridal, would a full refund be issued.

C. Any problems or faults must be reported to Lulu Jackson Bridal within 3 days of collection or delivery. The item must be returned for assessment within 7 days.

5. Fabric & make.

5.1   Lulu Jackson Bridal uses high quality, often natural based, fabrics such as silk, linen and cotton. While these fabrics have many wonderful qualities such as breathability and luxurious hand feel, it is accepted that they are also more prone to creasing and absorbing moisture spots than their synthetic counterparts. Fabric of this nature may carry minor slubs and imperfections which are not faults.

5.2   The fabrics, trims and construction techniques may be delicate and cannot handle undue stress, therefore any faults occurring after collection/delivery will not be considered as poor quality or make.

5.3 Bridal garments may feature an excess of fabric in some areas, such as trains, drapery or long ties. If so, it is the customers responsibility to acknowledge and accept this and wear such garments appropriately and with care.

5.3   Fabric is selected due to what is available at the time of design. Sometimes, there may be very slight differences between batches of the same fabric. Or, due to forces beyond our control, the chosen fabric may not be available. If the chosen fabric is unavailable for any reason Lulu Jackson Bridal will make every effort to source something similar or arrange a beautiful alternative.

5.4 For customers who are unable to browse and select a fabric in person physical swatches may or may not be sent, at the discretion of Lulu Jackson Bridal. If so, this will be included in the final cost.

6. Fittings/Fit.

6.1   Custom made garments may require 1-5 fittings. These may include fitting of existing samples, fitting of prototype samples, production fittings of unfinished garments, and/or a final fitting of the finished garment. There may be re-fits necessary at the discretion of Lulu Jackson Bridal. You must be available to attend these fittings in Mount Maunganui, unless discussed otherwise.

6.2 Important discussions made at all fittings will be recorded by Lulu Jackson Bridal. Any progress or changes are carried out at any time after each fitting, when continuing production of the garment(s). It is accepted that the garment(s) are a whole and a change to one area may affect another. At these fittings you must discuss any issues you may have or changes you wish to make. These will be ultimately at the discretion of Lulu Jackson Bridal. All details discussed at fittings are final unless discussed otherwise.

6.3 Fitting appointments may be postponed at times due to unforeseen circumstances, at the discretion of Lulu Jackson Bridal.

6.4   It is the customers responsibility to bring to all fittings the shoes, undergarments and accessories you’ll wear on the day of the event in order to have your garment properly fit. Lulu Jackson Bridal will not be responsible for ill fit related to changes in these items.

6.5 Lulu Jackson Bridal will not be liable for any marks/stains made on the garment during fittings from the customers body or cosmetic products.

6.6 Prototype samples are made and fitted at the discretion of Lulu Jackson Bridal. Prototype samples are made with suitable fabric and construction techniques for the designer and customer to best visualise the final garment. Prototype samples made in final fabrics may be used in the final garment.

6.7 Production fittings may be required at the discretion of Lulu Jackson Bridal. These are fittings of the final garment at various stages of production. Only some changes are possible in this stage and at the discretion of Lulu Jackson Bridal.

6.8 Once your garment is finished and the full payment has been made, a final fitting may be required. The garment is finished and accepted as final at this point. Unless discussed otherwise, at the fitting.

6.9 For customers who are unable to attend fittings in person with Lulu Jackson Bridal, fittings may be omitted. Or fittings may be carried out virtually, on a mannequin or fit model, and discussed over email or video chat and at the discretion of the designer. In some cases, physical garments may be sent for production or prototype fittings. Garments may or may not need to be returned to Lulu Jackson Bridal. If they do need to be returned, it will be at the discretion of Lulu Jackson Bridal and at the customers expense.

6.9  The fit of your garment(s) is based on the bust, waist and hip measurements Lulu Jackson Bridal takes at the time of consultation. Should your body shape, based on these measurements, change from this time until delivery/collection, it may require changes to the pattern and/or design and this may affect the final cost of the garment(s). Please advise Lulu Jackson Bridal promptly if you expect these measurements have changed or will change at any time from when they are taken/received until your wedding day. Lulu Jackson Bridal is not liable for ill-fit of garments due to any changes in the customers body shape, based on the measurements taken, from the time of consultation until the event day.

6.10   If for any reason between receiving your garment(s) and the event day you are not happy with the fit we welcome you to contact Lulu Jackson Bridal before making any alterations. If you choose to not return your garment to Lulu Jackson Bridal to be assessed, or to have it altered by a party other than Lulu Jackson Bridal, you will be liable for this cost and Lulu Jackson Bridal is not responsible for any alteration that is made.

6.11 For posted garments, any minor alterations required after receiving the finished garment, such as hem length, will be the customers responsibility and at their expense.

7. Collection/Delivery.

7.1   Your custom made garment(s) is typically finished no less than 2 weeks before your wedding date unless discussed otherwise.

7.2   Once the garment is finished, Lulu Jackson Bridal will perform a thorough quality control check, once satisfied, a final invoice will be issued.

7.3   Upon full payment of the final invoice (see clause 4.2) your garment(s) will be ready for collection or delivery.

7.4 If you choose to collect your finished garment(s) in person, this will include a final fitting if necessary. The garment is finished and accepted as final at this point. It is the customers responsibility to collect the garment from Lulu Jackson Bridal in Mount Maunganui, NZ. Your collected garment(s) will be packaged appropriately. Usually, hanging in a garment bag.

7.5 Postage of finished garment(s) may be required for customers who are unable to collect them in person. If postage is required the garment(s) is finished and accepted as final at this point.

A. Posted garment(s) will be packaged appropriately, usually folded into a box. They will need to be unpackaged and, possibly, steamed upon delivery. This is the customers responsibility.

B. Please provide a daytime delivery address for posted garments. Lulu Jackson Bridal cannot deliver to P.O. boxes, private bags or rural addresses. Your package must be signed for upon delivery.

C. Tracking details of your shipment will be sent once the garment has been dispatched.

D. For international orders, local guidelines apply once your purchase is in your country. Incurring customs duties and/or local taxes can happen with any international online purchase. These charges are determined by your destination, and the contents and value of the consignment. Charges of this nature are the responsibility of the receiver and not Lulu Jackson Bridal.

E. Your garment should be delivered within 14 days. All care is taken to deliver your order promptly, however Lulu Jackson Bridal takes no responsibility for postage delays beyond our control. Lulu Jackson Bridal does not accept responsibility for postage delays caused by insufficient delivery information.

F. Items lost or damaged in the post may not be refunded or replaced, but will be covered by standard postal insurance.

7.4   Once a garment has been collected or delivered, garment care is the responsibility of the customer. Lulu Jackson Bridal will provide garment care guidance only. Professional cleaners and dry cleaners are responsible for the correct care of your garment when it is in their hands. Lulu Jackson Bridal will not be responsible for any ill care of garments.

8. Cancellations & postponements.

8.1   Lulu Jackson Bridal will consider a change of event date to no earlier than 3 months before the initial date. You must contact Lulu Jackson Bridal to discuss any change of event date at least 3 months before the new event date. An urgent order fee may apply if there is a change of event date.

8.2   If you need to cancel your order at any time you must contact Lulu Jackson Bridal to discuss the circumstances surrounding the cancellation. Only in exceptional circumstances, and wholly at the discretion of Lulu Jackson Bridal, a refund may be issued at any point. However, there may be a $300 cancellation fee to cover the cost of administration, labour and materials associated with your order. All items pertaining to your order will remain the property of Lulu Jackson Bridal.

9. Circumstances outside of our control.

If, for any reason outside of our control, Lulu Jackson Bridal cannot complete the garment before the event date we may outsource the production of your garment(s) to our best ability before considering a refund.

10. Liability.

Lulu Jackson Bridal is not liable to you or anyone else for any financial loss or damage without limitation suffered as a result of negligence or otherwise arising in connection with use of our services and products.
